The phrase personal injury is commonly heard in today’s society, but what does it legally mean in the context of a compensation claim?

Personal injury
Personal injury is not only restricted to physical damage but can also include psychological problems. There are many occasions where the psychological symptoms of an accident are longer lasting than the physical disabilities.
You may have suffered from a fairly minor car accident, where your physical symptoms are just a stiff neck and seat belt bruising, however it may be that you can not face driving again, or driving in certain situations. Common examples of this type of psychological phobia include driving on a motorway or being stationary at traffic lights. Whilst the physical problems may resolve after a matter of weeks, the psychological symptoms may remain for months or even years or in more serious cases they may become chronic and last forever particularly in the elderly or more vulnerable drivers.
Your physical and mental well being is of paramount importance to your legal representative. A personal injury compensation claim can not be made until the injury is clarified and its effects understood. You will be asked to complete a questionnaire requesting information on how your injuries affect you in your day-to-day life. Are your walking, sleeping, housework, sports or hobbies affected? Are you affected at work, underperforming, missing out on bonuses or promotions? Did the damage caused to you affect the enjoyment of your holiday, Christmas or for example a wedding.
All these situations and many more, personal to you must be considered when bringing a compensation claim. Some people have to leave their job as they are not physically or mentally able to carry out their job. In these situations you can claim long term wages losses and you will be advised how to seek retraining and how such costs are recoverable from the insurance company.
There are people who suffer from restricted movement and need aids and appliances to help them through their day. You may need a bath lift or stair lift, walking aids or hearing aids; in fact the cost of any aid or appliance required due to the effects of the accident is recoverable from the insurance company.
You may need treatment for a broken leg or whiplash. Whilst your GP may tell you it takes weeks to obtain physiotherapy, osteopathy or other beneficial treatment, your legal adviser can usually obtain such treatments for you on a private basis in a matter of days. The costs of such treatment can very often be arranged to be paid directly by the insurer, so there is no cost to you at any stage.
Once you have completed your treatment, been assessed for any aids and appliances, and generally feel that things are settling down, you are ready for a medical report. Usually a report is obtained from an expert in the specific area of medicine that treats your injury. An orthopaedic consultant would prepare a report on a broken leg or arm. A plastic surgeon would prepare a report on scarring injuries etc. You will see the consultant and be able to discuss in detail how these problems affect you. The consultant will see your GP notes and hospital notes to establish what treatment you have had and what medication you have been prescribed. The consultant provides an opinion on how likely it is that your personal injury will be permanent or how long it will take for full recovery.
Based on all the above factors the value of your personal injury compensation claim is assessed by your legal adviser and a process of negotiation with the insurance company is commenced. Throughout this process you will be kept fully informed of the progress of negotiations. In the vast majority of cases agreement is eventually reached for the amount of compensation without the necessity of court action.
