In 2004/2005 there were 148 bicycle riders killed and 2,360
were seriously injured in road accidents in the UK (Department of Transport

At present the law does
not require cyclists to wear helmets, therefore the Courts do not reduce
compensation for cycle accident claims, even if the injury would have been
reduced if you had worn a helmet. Often insurance companies suggest that the
claimant is guilty of contributory negligence for not wearing a helmet however
whereas in motorcycle cases where the law requires a helmet to be worn, this is
correct, but in cycle accidents this is not the case.

How can

There are usually three main elements to cycle accident claims.
Personal injury
This is usually the most complicated part of the claim. Insurers usually do not want to go to Court as ultimately it costs them more, so they will normally agree
injury compensation in an out of court settlement rather than allowing the matter go to Court.
Damage to cycle
Usually a cycle is fairly modestly priced however we have dealt with claims where the value amounts to several thousand pounds. It is very helpful if you can find your original purchase receipt, especially if your cycle was recently purchased. As with all possessions that wear with time and use, the age of your cycle and the condition it was in at the time of the accident will be taken into account when agreeing a replacement value. If the cycle is repairable you should normally obtain two estimates, before getting the cycle repaired.
Loss of earnings
Normally this part of the claim is straightforward. Often we will speak to your employers to get them to confirm that but for you being off for a month you would have received the bonus. Usually insurers will accept this as sufficient evidence and pay you your lost bonus. If you are self employed then negotiations for income losses are based on your accounts.
