Discrimination claims can be made against both the employed and the
individual alleged to be behaving badly. There may also be potential
claims of breach of contract and unfair/constructive dismissal.
What is harassment?
It occurs when one person's or a group's behaviour towards another
gives offence. For example, such behaviour may take the form of
remarks designed to embarrass, inappropriate jokes or ridicule,
unwelcome physical contact, suggestions or demands for sexual favours,
racial shunning or segregation or racial abuse. Harassment at work can
be similar to bullying at school.
What is the legal position?
Employers can be liable for the actions of their workers at work or in
a work-related situation (e.g. a social event) unless they can prove
that they have taken all reasonable steps to prevent it occurring. A
worker could make a claim to an employment tribunal under the Sex
Discrimination Act, Race Relations Act or Disability Discrimination
Act.
What should employers do?
It is advisable to set up a separate complaints procedure for this
problem. Individuals may be reluctant to use the grievance procedure
if the complaint is of a personal nature or if the person concerned is
their line manager. ACAS can help to draw up such policy.
What is 'victimisation'?
Individuals may also bring a complaint of victimisation if they suffer
unfavourable treatment because they have in good faith taken part in a
"protected activity" under one of the Discrimination Acts. An example
is giving evidence in connection with a discrimination claim brought
by another person.
