Personal Injury
This is usually the most complicated part of the claim. Whilst damage
to your car can be independently verified by a motor engineer, and
losses of earnings are usually taken from your P60 or verified
accounts, there is no independent valuer of your injury. Your medical
expert needs to have a meeting with you, to discuss how your injuries
affect you in your day to day life. The expert will look at your GP
notes and hospital records to verify that you did actually attend your
GP on “seven occasions complaining of neck and back pain”, or that you
“regularly attended fracture clinic for your broken arm”. The notes
also show if you suffered a previous injury which you have not
recovered from or that you have a pre existing condition which has
been made worse by the accident. The report will explain what injury
you suffered. What pain and suffering you experienced over what period
of time. How your injuries restricted you at work, doing domestic
duties or in your social activities. How long it will take for your
injuries to settle down completely, or if they will not settle, what
permanent symptoms you will be left with. Your solicitor will then be
able to consider previous similar cases decided at Court to establish
how much road accident compensation you are likely to receive for the
pain and suffering for your personal injury. Insurers do not want to
go to Court as ultimately it costs them more, so they will usually
agree road accident compensation based on previous Court cases even
though your case does not go to Court.
Vehicle Damage
An independent assessor should normally inspect your vehicle shortly
after the accident to verify the damage. They will produce a list of
parts that need to be replaced and a costed time estimate for labour
to carry out the repairs. Very often the “audex” system is used, and
is almost always agreed by the other sides insurance company. Whilst
the cost of repairing the vehicle may be agreed, until liability is
accepted by the insurance company, they will not pay for the repairs.
If you have comprehensive insurance your own insurer will arrange for
the car to be repaired. Otherwise you either have to pay for the
repairs yourself or wait until the other sides insurer accepts
liability and pays for the repairs. There are also occasions when your
car is not repairable and in these circumstances it is important to
agree a written off value for your car. The value agreed should enable
you to buy the same model car in similar condition. It is often very
helpful to find newspaper adverts showing similar cars for sale to
justify the amount that you are requesting as compensation.
Lost Earnings
Normally this part of the claim is straightforward. You are employed
and have been off work for one month due to your injuries. You
normally receive £1000 net per month; the insurance company will pay
you £1000 for your loss of earnings. It becomes more complicated if
you expected to receive a bonus, but did not achieve it because you
were off work for a month and therefore did not quite reach your
target. Often we will speak to your employers to get them to confirm
that, but for you being off for a month, you would have received the
bonus. Usually insurers will accept this as sufficient evidence and
pay you your lost bonus. If you are self employed then your accounts
may not be comprehensive or up to date. This is usually the most
difficult type of loss of earnings to agree with insurers however an
experienced solicitor will be able to project anticipated earnings or
will call upon the services of a forensic accountant to verify
estimated losses.
